    1. Acceptance of Terms

    By accessing or using Mist's website and services ("Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

    2. Description of Service

    Mist provides a surf school management platform that enables surf schools to manage bookings, students, payments, instructors, and daily operations. The Platform may also provide a student-facing experience for browsing lessons and managing bookings.

    3. User Accounts

    • You must provide accurate and complete information when creating an account.
    • You are responsible for maintaining the confidentiality of your account credentials.
    • You are responsible for all activities that occur under your account.
    • You must notify us immediately of any unauthorised use of your account.

    4. Acceptable Use

    You agree not to:

    • Use the Platform for any unlawful purpose
    • Attempt to gain unauthorised access to any part of the Platform
    • Interfere with or disrupt the Platform's infrastructure
    • Upload malicious code, viruses, or harmful content
    • Scrape, harvest, or collect data from the Platform without permission
    • Impersonate another person or entity

    5. Intellectual Property

    All content, features, and functionality of the Platform - including text, graphics, logos, and software - are owned by Mist and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

    6. User Content

    You retain ownership of any content you upload to the Platform (e.g., school details, images). By uploading content, you grant Mist a non-exclusive, worldwide licence to use, store, and display that content solely for the purpose of operating the Platform.

    7. Payment Terms

    If you subscribe to a paid plan, you agree to pay all applicable fees. Fees are non-refundable unless otherwise stated. We reserve the right to change pricing with reasonable notice.

    8. Limitation of Liability

    To the maximum extent permitted by law, Mist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

    9. Disclaimer of Warranties

    The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

    10. Termination

    We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

    11. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Portugal.

    12. Changes to These Terms

    We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
